Suffolk County Sheriff’s deputies stopped Port Jefferson resident Domingo Olivo shortly after 12:30 a.m. on Sunday, Jan. 5 after he was caught swerving in and out of the right lane on County Road 97 in Holbrook.

During the subsequent stop, deputies said that Olivo was asked to perform standardized field sobriety tests but was unable to stand on his own, and he later refused to take a breath test.

Olivo was taken into custody and transported to Suffolk County Sheriff’s Office Station 1, where he submitted to a breathalyzer which determined his blood alcohol content was .09 percent, over the legal limit. He was charged with driving while intoxicated and multiple vehicle and traffic infractions.

No return court date for Olivo has been announced by the Sheriff’s Office.
